Vijay Construction’s application for appeal dismissed by Judge

Vijay Construction suffered another defeat in court last week in its case against the owners of Savoy Hotel after Judge Ellen Carolus rejected their two applications brought forward by their attorney, Bernard Georges.

The motions in question were brought before the court on Monday August 10, 2020, two days after their stay of execution expired and they failed to meet its demands for a bank guarantee for 20 million euros.

The first is to revisit the conditions of the stay of execution where they are able to give some other form of guarantee. The second motion was to grant Vijay Construction the right to plead the conditions before the Court of Appeal.

In her judgement on Friday afternoon, Judge Carolus noted that the applications will be dismissed and not be entertained as they were filed two days after the stay of execution had expired on August 7.
